We'll update some polls here with Juju in a second, but just Amin and Pablo, since we have the Pulitzer winners here, and just hypothetically, okay, because I've been watching this Kawhi situation and the reporting that you guys are doing, and I'm like, how is the NBA going to wiggle out of this? Just hypothetically, if you were to try to arrange things between all parties so that you can get no loud objection from any NBA people in this scenario. Wouldn't Toronto be the angriest group here because of how they lost Kawhi? And if they get Kawhi now in the exchange years later, isn't this one of the creative ways that you could arrange it if you were trying to do that hypothetically?

It's about the most convenient outcome is how this all is smelling like right now. Um, look, the question of what does the NBA fear as a result of their decision on the Clippers— they would fear the foremost, uh, example of a team that got wronged, the Raptors. They would fear a, a, perhaps a podcast that would say, how could you do nothing? And they would ostensibly worry about the fans who would make noises. And if you can thread a needle by getting Kawhi to Raptors, a 5th overall pick in a stacked draft to the Clippers, and if you could do something, something so that a certain podcast can't say you did nothing, then suddenly you have read the board as strategically as you possibly could.

The difficult part that they have to tread— we're all talking with the air of certainty that we know that the Clippers did something untoward, but there is a realm where everything they do can be explained away in a way that, hey, letter of the law, we didn't actually do it. Forget about the intent, we didn't actually do anything wrong. And so within that small window, the NBA can make the leap according to Article 13 that, hey, if this ended up in this way, you're guilty anyway. They can make the leap of saying we can't prove that they circumvented the cap intentionally, even though that was the outcome. And as a result We can levy this punishment, which would be commensurate with what happened with the Timberwolves years ago— a bunch of draft picks, uh, suspension of key individuals. But the biggest gift that they could give is to take Kawhi away and give him to another team. And that's what seems to be happening. That's why, uh, Pablo's Larry Tannenbaum theory is very interesting, because if there were someone who were going to be kept abreast of the situation. It would be the chairman of the Board of Governors.

No, I mean, keep in mind just the backstage— what the NBA does not like telling the fans, uh, is that Larry Tanenbaum, chair of the Board of Governors, Steve Ballmer on the audit committee, right? Like, these are people who are in charge of very important aspects of how the NBA governs itself. And so, look, what I mean is saying in terms of letter of the law is very interesting because of course the question then becomes, how do you define rational explanation? But I think even more pressing for the NBA, Dan, to your question of like, how would you do it if you wanted to minimize the problem here? You would also limit the scope of your investigation. And what we reported in that episode we did at Sloan with the whistleblower complaint, which to me is a document that cannot be more persuasive because it was made in 2023. It was the roadmap the federal government used to prosecute Joe Sandberg, who has now been sentenced to 14 years in prison. And the same people, the same whistleblowers, the two of them who are Aspiration employees, also specifically say before we reported anything independently that this was carbon credits to circumvent the salary cap for Kawhi Leonard by the Clippers for a sham organic sponsorship agreement, right?

That same episode, we also pointed out— I reported that 5 Aspiration sources said that they were not asked about Steve Ballmer. They were not asked. And so the question of what does the NBA do and how do they do it strategically? Well, you find out what you want to find out, and you don't ask the questions that can lead to answers that you don't want to know because you have an outcome that you're driving to, an outcome that you have a sense of because you're smart and because you're run by lawyers, and all you got to do is make sure that nothing gets in the way of the outcome you want to determine.
