At 1 in the morning, hours before polls even opened, the President of the United States was on Truth Social in all caps, claiming a Senate candidate in Alaska may have been kidnapped by Democrats. That's where we are. And this morning the President spiraled in a Fox News interview, suggesting he would just "move to Israel" and become Prime Minister of Israel if Americans get tired of him. It is Election Day in the United States of America. Everything. Everything that we have worked toward over the past 18 months is here today.

And there is so much to cover this morning. I am going to be with you every step of the way, because today is the day we've all been waiting for, and we have a lot to get to: Trump's closing argument, a Republican Party cracking, a string of court losses overnight for this administration, the war in Iran heating up on Election Day itself, and so much more. Here's how the next 48 hours are going to work. At 5:00 p.m. Eastern Time today, I'll have my final newsletter of the day featuring Gavin Newsom, California Governor. At 6:00 p.m.

Eastern Time, we're going to go live for Election Night Live, all the way until midnight. Then at midnight, you're going to get another newsletter in your inbox featuring where we are today, and then another tomorrow morning at 9:10 a.m. Eastern Time. I won't be sending every individual race call. I'll send an update the moment we know who controls the House, who controls the Senate. It's going to be a long 48 hours, but back when I practiced law, I once went 72 hours without sleep. Was that healthy? No. But I'm built for this 48 hours of nonstop election coverage. I'm excited.

If you can, subscribe, support this work, keep me caffeinated, like, comment, share, and let's—well, let's just jump right in, because we have some big news to cover this morning. Let's start with the map, because the numbers tell the story. Right now, Republicans in the Senate hold 53 seats to 47 seats. Democrats need a net gain of 4 seats to take control. In the House of Representatives, the margin is even tighter: 3 seats. Republicans can lose. If Democrats gain 3 seats, they will take control of the House of Representatives.

Every single election forecaster predicts the House will go blue. The Senate is going to be closer. Right now, we're seeing historic turnout: more than 57 million Americans voted early, blowing past the 46 million in 2022. In Texas alone, early voting has been up 41%. And while Donald Trump gave his closing argument to folks in states across the country today, his closing argument is: "If we have to bomb a lot of people and kill a lot of people, we will, and I may move to Israel."

Take a listen.

Speaker 200:02:35

I know we had to take this little detour because Iran could not have a nuclear weapon.

Speaker 300:02:40

Yep, we had to do it.

Speaker 200:02:41

But after the election.

Speaker 300:02:42

And it's been totally successful, by the way.

Speaker 200:02:44

Yes, sir. Yes, sir. It's been one of the greatest victories of this administration. But what's going to happen after Election Day, after today? What's the next move?

Speaker 300:02:53

Well, we'll see. Look, I'm not looking to, you know, kill lots of people. But if we have to, we'll have to. But I'm not looking to do that. Do need it. If for some reason they do need it or they need help. So I'm the number one. I was so voted. I'm at 99% approval rating in Israel. Can you believe it? In fact, if people ever got tired of me in the U.S., I'll move to Israel and become Prime Minister. But I'm at 90. Think of it. I'm at 99. I have the highest approval rating of anybody in history. Because I've been, you know, I've been—they've been a great partner.

But what we did, we stopped Iran. Iran was.

Aaron Parnas00:03:27

So that's the closing message. Now, overnight, the United States did conduct, quote, "defensive strikes" in Qeshm Island in Iran. It did look as though it was a limited strike. The war hasn't restarted full-blown, right, to the point where we're bombing across Iran. It was—it looked as though it was limited strikes. But we'll have to see what tomorrow brings. We'll have to see what tomorrow brings. But what today is bringing is a President who is seemingly spiraling. He spiraled during this interview on Fox News. He spiraled overnight, yelling in all caps, misspelling Daniel, saying, "Fake Alaska candidate Daniel J.

Sullivan, Jr. is missing in action. He has totally disappeared, gone. Nobody has been able to find him," saying, quote, "Maybe he's been kidnapped by corrupt Democrat lawyers. They are scared stiff of being prosecuted for election fraud." And this morning, his Department of Justice announced a list of counties across the country, primarily blue counties, primarily counties that vote for Black majority counties, Latino majority counties, primarily blue counties across the country where there are going to be these election monitors.

Now, I want to talk about these election monitors for a bit, because I think it's important for you guys to remember that these election monitors are not FBI agents. They're not ICE agents. These are ATF agents, BOP agents, Bureau of Prisons, and others. They cannot go inside the polling sites. They cannot tell you who to vote for. They cannot meddle in your vote tallies. They cannot do any of that. They have to stand outside of the polling site, a certain distance away. They cannot. They cannot bother you. Now, I do want to address a couple of things, because this morning there were some issues in Westchester County in New York.

I am aware of those. The state of New York is aware of those. There are some issues with ballot tabulating machines. You can still go vote. Everything is fine. Everything is normal. The machines themselves may not be fully operable, but you can get a paper ballot. The only thing is, New York's 17th Congressional District, which is where Westchester County is, is one of the most swing districts in the country. And so it may just take a little longer tonight into tomorrow to get results from New York's 17th and figure out whether or not the Republican incumbent there, Mike Lawler, is able to hold on, or whether Kate Connelly, the Democrat, is able to defeat him.

But overnight, what we did learn is that loss after loss after loss piled up for the Trump administration in court. Yesterday and into the late-night hours, the United States Supreme Court rejected Trump's bid to force California to set aside 20,000 ballots with no noted dissents. We talked about that yesterday. And then the full Ninth Circuit Court of Appeals restored an order from Judge Trina Thompson barring the Department of Justice from threatening election officials with prosecution. So this order will run through November 16th. It'll cover today, Election Day, and the count afterwards.

In addition, Judge Tanya Chutkan in Washington, D.C., blocked the Department of Homeland Security and the Department of Justice from sending lists of supposedly, quote, "ineligible voters" to states. The government had collected voter rolls containing tens of millions of people from at least 47 states, including Social Security numbers, birth dates, and party affiliation. Chutkan found that no law authorizes this program and that it likely will violate a privacy act. So every single election interference effort by the Trump administration in the courts has failed.

The Supreme Court of the United States has sent a really clear message to Donald Trump overnight with the no-noted dissents in the California case, essentially saying, "We're not going to set aside your 20,000 ballots just because you want us to." And on top of it, on top of it, don't come with any BS to the Supreme Court, because we're not messing around. That's kind of the message the Supreme Court sent to the Trump administration. Quick note, finally, this is kind of what we're going to be looking at tonight on our live. The first results are going to come in in places like Kentucky and Indiana and Virginia.

Kentucky, Indiana, parts of the state, has polls closing as early as 6:00 p.m. Eastern Time. We're looking at Kentucky's 6th Congressional District. We're looking at the Indiana district where Victoria Sparks is currently a congresswoman. Those are going to tell us kind of where we are initially, because if Democrats are able to flip that district in Indiana and the Kentucky district, we would be looking at a blue tsunami. And then you go to Virginia, where polls close at 7:00 and ballots are counted quickly. We have swing districts up there. And then the big states like Florida, Georgia, South Carolina, the first Senate races that we're going to be looking at close shortly thereafter.

Aaron Parnas00:07:52

And we're going to be covering it all for you all night long on every single platform. 6:00 p.m. Eastern Time, Trump closed his campaign talking about Koch. His party is splintering. His legal efforts are failing. And it's Election Day. I'll see you.
