So there's actually three tracks going on in the Menendez case. There's a habeas petition that was filed in May of 2023 and that deals with the new evidence. And it basically says, is this new evidence compelling enough to overturn a verdict that's now over 30 years old? That's the first track. The second track is clemency.

Any time since the governor's been governor, Newsom has been the governor in 2017, he can grant clemency and release the Menendez brothers. He could do it today. That's the second track. And it basically says using an analysis of a thorough review of all the facts and all the law, should a life without the possibility of parole sentence be reduced to something like 50 years to life, which is what my predecessor recommended, I'm going to be doing that thorough review of the facts. And the law is apparently the judge will as well. That involves reviewing thousands of pages of prison records, thousands of pages of trial transcripts from two months long trials, speaking to the prosecutors, speaking to defense counsel, speaking to law enforcement and the victim families. And at that point, I will be prepared to sort of weigh in on the Menendez case and defend that issue in court.
